As of today, you will find the new Guidelines for the examination of trademarks on absolute grounds on our website. The new guidelines are being issued owing inter alia to recent changes in legislation and to recent case law.
The new guidelines take on board the amendments to the BCIP (TM package), the most recent EU and Benelux case law and various shared practices (convergence). In a nutshell, they are completely up to date again. The document has also been re-structured for the convenience of users: it now presents the guidance article-by-article.
BOIP greatly appreciates the input provided by the BMM (Benelux Consultation Commission) during the development of the Guidelines.
